What You Need To Know
AB 1033, also known as the Accessory Dwelling Unit (ADU) Reform Act of 2023, is a California law that makes it easier and more affordable to build ADUs. ADUs, also known as granny flats or in-law units, are secondary residential units located on the same property as a single-family home.
AB 1033 streamlines the process of building and permitting ADUs by doing the following:
- Requiring local governments to allow ADUs on most single-family residential lots.
- Eliminating parking requirements for ADUs in most cases.
- Allowing ADUs to share utilities with the main house.
- Prohibiting homeowners associations from banning ADUs.
- Allows for a local agency to adopt an ordinance allowing for the separate sale of accessory dwelling units (ADUs) and the primary dwelling on the property as condominiums. Such an ordinance must contain specific requirements. (Contact your local government agency for more information)
AB 1033 is designed to increase the supply of affordable housing in California, reduce traffic congestion, and allow seniors to age in place. Here are some of the intended benefits of AB 1033:
- More affordable housing: ADUs can provide affordable housing for seniors, young adults, and families.
- Reduced traffic congestion: ADUs can allow people to live closer to where they work and play, which can reduce traffic congestion.
- Aging in place: ADUs can allow seniors to age in place by providing them with a comfortable and affordable place to live close to their families and communities.
- Increased income: Homeowners who rent out their ADUs can generate additional income.

Here are some additional things to keep in mind about AB 1033:
- AB 1033 does not apply to multi-family housing properties, such as apartments and condominiums.
- AB 1033 does not require local governments to provide financial assistance for ADU construction.
- AB 1033 does not supersede local ordinances that are more restrictive than the state law.
AB 1033 was signed by the Governor on October 11, 2023 and takes effect January 1, 2024.
